02Acceptance of these terms

By using our website, requesting a quote or placing an order, you agree to these Terms & Conditions, our Privacy Policy and our Returns and Delivery policies. If you do not agree, please don't use our services.

If you are accepting on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity to these terms.

03How orders work — the quote model

We operate on a quote-and-confirm model. Prices are not shown on our website because every order's pricing depends on quantity, decoration method, branding artwork and delivery context.

The process is:

• You browse our catalogue and request a quote for the products and quantities you're interested in
• We respond with a tailored quote, typically within one working day
• If you accept, you approve a digital artwork mockup before any production starts
• Once you confirm and any required deposit is paid, the order moves into production
• We dispatch and deliver the finished branded goods to the address you nominate

04Pricing, quotes and payment

Each quote is valid for the period stated in it (typically 14 days). After that we may need to re-quote due to stock, currency or supplier-cost movements.

Unless we agree otherwise in writing:

• All prices are in South African Rand (ZAR), exclusive of VAT unless specifically stated
• Payment terms will be set out in each quote — typical terms involve a deposit on confirmation and the balance prior to dispatch
• We accept EFT and any other payment methods specified in the quote
• Production only begins after artwork sign-off and payment terms are met

05Custom-branded products

Most of our orders involve products that are decorated with your logo, artwork or other custom branding. This has important consequences you should be aware of:

• Once production has started on a custom-branded order, it generally cannot be cancelled — the branded stock has no resale value to another customer
• Custom-branded goods are exempt from the cooling-off rights in Section 44 of the Electronic Communications and Transactions Act ("ECT Act"), because they are made or adapted to your specification
• You are responsible for ensuring the artwork you provide does not infringe any third-party intellectual property rights (see section 9)
• Slight variation in colour, position or finish is normal in physical decoration processes — your approved mockup is the reference, but minor variation is not a defect

06Delivery and risk

Standard delivery terms:

• We deliver across South Africa via our trusted courier partners
• Delivery typically takes 2–7 working days after dispatch (full details on our Delivery Policy page)
• Risk in the goods passes to you on delivery to the address you nominated, or to a representative at that address
• If we are unable to deliver within the period stated in your quote, we'll let you know — you may then elect to wait or cancel that part of the order for a refund of any amount you have paid for it

07Returns and warranty

Please refer to our Returns Policy for the full detail. In summary:

• Custom-branded items can't be returned simply because you change your mind — see section 5
• If a product is defective, damaged in transit, or materially different from what was agreed in your approved mockup, please let us know within 7 days of delivery and we will arrange a replacement, repair or refund
• Your statutory rights under the Consumer Protection Act, 2008 (where it applies) are not affected by these terms

08Intellectual property — your artwork and ours

By providing artwork, logos or other design files to us, you:

• Warrant that you have the right to use those files and to authorise us to reproduce them on the products you've ordered
• Grant us a limited licence to reproduce the artwork solely for the purpose of producing your order
• Agree to indemnify us against any third-party claim that arises from your artwork infringing intellectual-property rights

All website content not provided by you — including our product descriptions, images, branded photography, copy and design — remains the intellectual property of Vics Promotional Items (Pty) Ltd or our licensors. You may not copy, republish or commercially reuse our content without written permission.

09Limitation of liability

To the maximum extent permitted by South African law:

• Our total liability to you under or in connection with any order is capped at the price of the affected goods in that order
• We are not liable for indirect, consequential, special, incidental or punitive losses (including loss of profit, business interruption, loss of opportunity or reputational damage)
• Nothing in these terms limits any liability that cannot lawfully be limited under South African law

10Force majeure

We're not liable for any delay or failure caused by events outside our reasonable control — for example load-shedding, natural disasters, courier disruptions, pandemic-related restrictions, civil unrest, supplier failure or unforeseen production interruptions. We will, however, communicate promptly and work with you to resolve the situation.

11Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. If a dispute arises, we'd like to resolve it directly with you — please email accounts@vics.co.za first.

If we cannot resolve it informally, both parties consent to the non-exclusive jurisdiction of the Pretoria Magistrate's Court or other competent South African court for the resolution of any dispute, regardless of the value of the claim.

12Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes in our business or applicable law. The version in force at the time you confirm an order is the version that applies to that order. The latest version is always available on this page with the "Last updated" date refreshed.
